2. Processing of Your Personal Data

a. What data of yours do we use, and where does your data come from?

We process the data we receive from you or, where permitted, from third parties (such as government agencies, insurance companies, etc.) as part of the application process.

This includes, in particular, your personal details (e.g., name, address, contact information, date and place of birth, nationality), identification data (e.g., ID information), authentication data (e.g., signature sample), insurance data (e.g., Social Security number), health data (e.g., sick days), qualification documents (e.g., certificates, evaluations, proof of training), as well as, where applicable, other data related to the application (e.g., resume).

You are under no legal or contractual obligation to provide us with your personal data. Failure to provide such data may adversely affect our decision regarding whether to enter into an employment relationship with you.

b. For what purposes and on what legal basis do we process your data?

We process your personal data in accordance with the data protection regulations of the German Data Protection Act (DSGVO), the German Federal Data Protection Act (BDSG) or special legal regulations for decision-making on whether we establish an employment relationship with you.

The purpose of the processing depends on the requirements of the implementation of the application procedure (e.g. invitation to interviews, carrying out assessments, evaluation of your performance).

The legal basis for data processing is Art.88 DSGVO in conjunction with. § 26 para. 1 sentence 1 BDSG (new) or, in the case of consent, Art.6 para. 1 lit a) DSGVO.

c. How long will your data be stored?

We process and store your data for the duration of the application process plus a further 3 months. Afterwards, your data will be deleted immediately.

If, based on your application profile, we are interested in storing your application data for a longer period, we will inform you of this and obtain your consent.

Passing on your data

a. Who receives your personal data?

Within the company, your data is only shared with those departments that need it to conduct the application process and to comply with legal obligations. Processors and other service providers we engage may also receive data for these specified purposes. These are companies in the IT services and telecommunications sectors.
We use the Sopea application portal on our website to post job openings and enable online applications. We implement this service using a so-called iframe. The service provider for this is sopea GmbH, Fellbacher Straße 115, 70736 Fellbach.

We only disclose information if required by law, if you have given your consent, or if we are authorized to provide such information.

Under these conditions, recipients of personal data may include, for example, public authorities and institutions (e.g., government agencies, tax authorities) where there is a legal or regulatory obligation to do so. Other recipients of data may be those entities for which you have granted us consent to transfer your data.

b. Is your data transferred to a third country or to an international organization?

No data is transferred to countries outside the European Economic Area (third countries).

Your rights

You have the right to access (Art. 15 GDPR), rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR), data portability (Art. 20 GDPR), and the right to object to processing (Art. 21 GDPR). Please contact us if you wish to exercise these rights.

You may withdraw your consent at any time with future effect pursuant to Article 88 of the GDPR in conjunction with Section 26(2), Sentence 1 of the BDSG. This does not affect the lawfulness of the data processing carried out prior to your withdrawal.

If you believe that the processing of your personal data violates applicable data protection laws, you may file a complaint with a supervisory authority, without prejudice to any other legal remedies. In particular, you may file a complaint with a supervisory authority in the Member State where you reside, where you work, or where the alleged violation occurred.
